Terms of Service
These Terms of Service ("Terms") are a binding agreement between you and TableGenie, Inc. ("Table Genie," "we," "us," or "our"), governing your use of the Table Genie mobile application (the "App"), our website at tablegenie.com (the "Site"), and all related features and services (together, the "Services").
By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services. You must be at least 18 years old to use the Services.
We may update these Terms from time to time. Changes take effect when we post them and update the "Last updated" date, and your continued use of the Services means you accept the updated Terms.

1. Our Services
Table Genie is a platform that helps diners discover restaurants and venues; make reservations; arrange home catering and events; preview dishes and tables in 3D and augmented reality; order collaboratively at a shared table by scanning a QR code; and interact with an AI voice concierge called "Genie."
Table Genie is a facilitator, not a restaurant. Restaurants, chefs, caterers, and venues ("Merchants") are independent third parties who are solely responsible for their food, menus, pricing, availability, service, and for honoring reservations and orders. We do not prepare food, own the venues, or guarantee that a Merchant will fulfill any reservation or order. Menu items, prices, availability, and hours are provided by Merchants and may change or contain errors.
2. Eligibility and your account
You represent that you are at least 18 years old, have the legal capacity to agree to these Terms, and will use the Services only for lawful purposes and in compliance with these Terms and all applicable laws.
The App does not use traditional accounts, usernames, or passwords. Instead, your device is assigned an anonymous identifier that ties your reservations and orders to your device. You are responsible for maintaining the security of your device and for activity that occurs through it. If you lose access to your device, you may lose access to reservations and orders associated with it.
3. Reservations, orders and events
When you place a reservation, order, or event/catering request through the Services, you are making a request to the applicable Merchant. A reservation or order is a commitment to attend and, where applicable, to pay the amounts due. You agree to provide accurate contact information (such as name, email, and phone) and to honor the reservations you make.
Some reservations require a minimum order value or a deposit set by the Merchant. Where a Merchant does not require a minimum order, you may be able to reserve a table without selecting dishes and without a deposit. We will send you a confirmation of your reservation by email.
4. Payments, deposits, fees and tips
Payments are processed by a third-party, PCI-compliant payment processor. By providing a payment method, you authorize us and our payment processor to charge the applicable amounts. Payments are in US dollars and by card (Apple Pay is supported on eligible devices). We do not store your full card details; see our Privacy Policy.
- Reservation deposit. When your reservation includes a pre-selected order, we charge a deposit of 10% of the order subtotal (subject to a small minimum) at the time of booking. The deposit is applied toward your final bill. If there is no order subtotal and the Merchant requires no minimum, no deposit is charged.
- Live shared-table checkout. At a live table, you pay the amount owed for the table or your share of it (see Section 6), plus any tip you choose to add. Any deposit already paid is credited toward the total.
- Tips. Tips are optional and added at live-table checkout. The full amount of any tip you add goes to the Merchant.
- Platform fee. Table Genie charges Merchants a service/commission fee on transactions processed through the Services. This fee is retained by us out of the amounts collected; the remainder is paid out to the Merchant through our payment processor.
- Split payments. A shared table may be settled by one person, split by person, or split evenly. Only one person can settle at a time, and your payment is limited to the outstanding unpaid balance. If more than the amount due is collected, the excess is refunded automatically.
5. Cancellations, refunds and changes
- Refund window. A reservation deposit is fully refundable if you cancel more than 3 hours before the reservation time. If you cancel within 3 hours of the reservation, the deposit is non-refundable.
- Editing. You may change a reservation's time or items up until 1 hour before the reservation.
- Who can cancel. Only the person who created a reservation may cancel it or request its refund. Guests invited to a shared reservation may edit items and time (within the edit window) but cannot cancel the reservation or remove other participants.
- Merchant issues. If a Merchant cannot honor a reservation or order, we will work to arrange a refund of amounts you paid to us for that reservation, but we are not responsible for the Merchant's independent conduct.
Except as stated here or as required by law, amounts paid are non-refundable. Refunds are returned to your original payment method through our payment processor.
6. Shared tables and shared reservations
The Services let multiple people order and pay together:
- Live shared tables. The first person to scan a table's QR code becomes the "host" and approves or declines others who ask to join. If the host removes or declines a person, the items that person added are removed. Each participant's chosen display name and the items and comments they add are visible to the others at the table.
- Shared reservations. A reservation can be shared by link. Anyone with the link can view the reservation preview and, on joining, can view and edit the shared reservation. Only the original creator can cancel the reservation or remove participants.
If you invite others or share a link, you are responsible for who you share it with. Do not share links with people you do not intend to give access to the reservation or table. Each participant is responsible for the items they add and the amounts they agree to pay.
7. Genie AI voice assistant
"Genie" is an optional AI voice concierge that you activate by tapping the Genie control and speaking to it. Genie can help you find restaurants and dishes, answer questions, and start or modify reservations and a cart on your behalf.
Using Genie requires microphone access and streams your voice and conversation to our voice-AI providers, as described in the Privacy Policy. By using Genie you consent to that processing. Genie may be unavailable on some devices or during another active phone call.
8. 3D and AR features
The Services can render dishes and tables in 3D and augmented reality using your device camera. AR shows an approximate digital representation and is for preview purposes only; actual dishes, portions, and tables may differ. Use AR features responsibly and only where it is safe to do so — do not use them while driving, walking in traffic, or in any situation where distraction could cause harm, and be mindful of your surroundings and others' privacy.
9. Your content and submissions
You may provide content through the Services, such as a display name, dish comments and notes, and messages you send us ("Your Content"). You retain ownership of Your Content, and you grant us a worldwide, non-exclusive, royalty-free license to use, host, store, reproduce, and display Your Content as needed to operate and provide the Services (for example, showing your name and item notes to others at your shared table, and transmitting your requests to Merchants and providers).
You are responsible for Your Content and represent that you have the rights to provide it and that it does not violate any law or third-party right. Do not submit content that is unlawful, infringing, deceptive, harassing, hateful, obscene, or that impersonates another person. We may remove content that violates these Terms. If you send us feedback or suggestions, you grant us the right to use them without restriction or obligation to you.
10. Prohibited activities
You agree not to:
- use the Services for any unlawful, fraudulent, or unauthorized purpose, or to make fraudulent or bad-faith reservations, orders, or payments;
- impersonate another person, or join a shared table or reservation you were not authorized to join;
- interfere with, disrupt, overload, or attempt to gain unauthorized access to the Services, our systems, or the systems of our providers or Merchants;
- scrape, harvest, or systematically collect data or content from the Services, or use it to build a competing product;
- circumvent, disable, or interfere with security or usage limits, or reverse engineer any part of the Services except where permitted by law;
- misuse the Genie assistant, including attempts to make it perform harmful, abusive, or unauthorized actions, or to generate excessive automated requests; or
- upload malicious code or otherwise harm the Services or other users.
11. Intellectual property
The Services and everything we create for them are owned by or licensed to Table Genie and are protected by intellectual-property, database, and unfair-competition laws. This includes, without limitation: all software, source code, and APIs; the design, layout, and user interface of the App and the Site; text, graphics, illustrations, audio, and video; all photography and imagery of dishes, venues, tables, and decorations, including AI-enhanced and AI-generated imagery; all three-dimensional and augmented-reality assets, including glTF and GLB models, meshes, geometry, textures, materials, and every compressed, optimized, or derived variant of them at any level of detail; floor plans and venue scenes; and the selection, arrangement, structure, and compilation of the restaurant and menu catalog and its associated data (together, the "Content"), together with the Table Genie name, logo, and other brand features (the "Marks").
Merchant-supplied material
Merchants retain ownership of their own names, logos, and trademarks, and of the menu text, descriptions, and source photographs they supply to us. Table Genie owns all photography, imagery, 3D models, and AR assets that Table Genie or its providers create, capture, enhance, or generate for the Services, including assets generated from a source image or other material a Merchant supplies. A Merchant's rights to use those assets outside the Services are governed by its separate written agreement with us and, in the absence of such an agreement, are not granted.
Your license to use the Content
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access the Services and to view the Content as it is presented to you in the App or on the Site, for your personal, non-commercial use only. You may not download, extract, copy (beyond the ordinary caching your browser or the App performs to display the Content to you), republish, distribute, sell, license, publicly display, host, mirror, frame, hotlink, modify, or create derivative works from any Content, and you may not use any automated means to access, retrieve, index, or store Content, except as these Terms expressly permit or as we agree in writing beforehand.
Reservation of rights for text and data mining
We expressly reserve all rights in the Content against text and data mining, web scraping, and the extraction, reproduction, or use of Content to develop, train, fine-tune, evaluate, or ground any machine-learning or artificial-intelligence model, product, or dataset, including for retrieval-augmented generation. This is an express reservation of rights for the purposes of Article 4(3) of Directive (EU) 2019/790 and any equivalent or successor law, and it applies whether or not access to the Content is technically restricted. Nothing on the Services grants any such right by implication, and a machine-readable permission we publish for one part of the Services does not extend to any other part. Any license for these uses must be obtained from us in writing at [email protected].

12. Third-party services
The Services rely on and link to third-party services, including payment processing, voice and AI providers that power the assistant, mobile app platforms and device services, and email and infrastructure providers. Your use of those services may be subject to their own terms and privacy policies, and we are not responsible for third-party services or for Merchants' independent acts or omissions.
13. Mobile application license
We grant you a revocable, non-exclusive, non-transferable, limited license to install and use the App on a device you own or control, solely for your personal use and in accordance with these Terms and any applicable app-store rules. You may not rent, lease, sell, redistribute, decompile, or reverse engineer the App except as permitted by law. If you obtained the App from the Apple App Store, you acknowledge that these Terms are between you and Table Genie (not Apple), that Apple has no obligation to provide support or handle claims relating to the App, and that Apple is a third-party beneficiary entitled to enforce this section against you. If you obtained the App from Google Play, you acknowledge that these Terms are between you and Table Genie (not Google), that your use of the App must comply with the then-current Google Play Terms of Service, that Table Genie (not Google) is solely responsible for the App, that Google has no obligation to provide support or handle claims relating to the App, and that Google is a third-party beneficiary entitled to enforce this section against you.
14. Term and termination
These Terms apply while you use the Services. We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms, misuse the Services, or as needed to comply with law or protect the Services or others. You may stop using the Services at any time by discontinuing use and deleting the App. Provisions that by their nature should survive termination will survive.
15. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT AI-GENERATED OUTPUT (INCLUDING GENIE) WILL BE ACCURATE, OR THAT ANY MERCHANT WILL FULFILL A RESERVATION OR ORDER. RESTAURANTS, CATERERS, AND VENUES ARE INDEPENDENT THIRD PARTIES, AND WE ARE NOT RESPONSIBLE FOR THEIR FOOD, SAFETY, CONDUCT, OR THE ACCURACY OF THEIR MENUS OR PRICING. YOUR USE OF THE SERVICES IS AT YOUR OWN RISK.
16. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TABLEGENIE AND ITS OFFICERS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES. TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO US IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) US $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.
17. Indemnification
You agree to indemnify and hold harmless Table Genie and its affiliates from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising out of your use of the Services, Your Content, your violation of these Terms, or your violation of any law or third-party right.
18. Governing law and disputes
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict-of-laws rules. You agree to first try to resolve any dispute informally by contacting us at [email protected]. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the state and federal courts located in Delaware, except where applicable law gives you the right to bring proceedings elsewhere. Nothing in these Terms limits any non-waivable statutory rights you may have as a consumer.
19. Miscellaneous
These Terms, together with the Privacy Policy, are the entire agreement between you and Table Genie regarding the Services. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. We may provide notices to you electronically, and you consent to receiving communications and transacting electronically. We are not liable for delays or failures caused by events beyond our reasonable control.
20. Restaurant operational SMS alerts
Restaurant owners and staff may choose to receive recurring, non-marketing operational SMS messages from Table Genie by entering their own mobile number in the password-protected Table Genie admin dashboard and affirmatively checking the standalone SMS consent checkbox. SMS consent is voluntary, is separate from acceptance of these Terms and our Privacy Policy, and is not a condition of purchase.
- Message purpose. Messages may notify recipients about new reservations, reservation cancellations, and items guests add to open table orders.
- Frequency. Message frequency varies based on restaurant activity.
- Charges. Message and data rates may apply according to your mobile carrier and plan.
- Opt out. Reply STOP to opt out. After opting out, you will receive no further operational SMS messages unless you enroll again.

Mobile carriers are not liable for delayed or undelivered messages. Delivery is subject to mobile-network availability and the continued operation of the Table Genie Services.
